Enforcement submission in occasional rental under Polish Civil Procedure Code
What is Art. 777 CPC?
Art. 777 § 1 point 4 of the Polish Civil Procedure Code allows enforcement of the obligation to vacate a property based on a notarial deed in which the tenant submitted to enforcement. This is the legal basis for simplified eviction in occasional rental.
How it works
- Tenant and landlord sign an occasional rental agreement at a notary.
- Tenant submits to enforcement.
- Tenant designates a substitute address with the owner's consent.
- After lease end — if tenant doesn't vacate — landlord directs the case to a bailiff under Art. 777.
Substitute address role
Without a valid substitute property owner's statement, enforcement may be suspended.
